Ordinance 658 Report <br />May 8, 2000 <br />Page 5 <br /> <br /> <br /> <br /> ORDINANCE NO. 658 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />AN EMERGENCY ORDINANCE AMENDING SECTION 1103.08, SUBDIVISION 3, OF <br />THE MOUNDS VIEW ZONING CODE, PERTAINING TO THE LOCATION AND <br />HEIGHT OF FENCES WITHIN THE CITY OF MOUNDS VIEW <br /> <br /> <br /> WHEREAS, the City Council of the City of Mounds View has been made aware of a <br />situation in which a Mounds View resident has been subjected to ongoing verbal and mental <br />harassment from an adjacent property owner; and, <br /> <br /> WHEREAS, the Mounds View Police Department has confirmed the existence of the <br />harassment situation, has logged many calls regarding the source of the harassment, has issued court <br />citations to and has arrested the alleged harasser; and, <br /> <br /> WHEREAS, the Mounds View resident subjected to the harassment has requested a permit <br />to construct an eight-foot tall fence that would extend into the front yard to provide for increased <br />personal privacy and to possibly reduce the opportunities for harassment; and, <br /> <br /> WHEREAS, according to Section 1103.08, Subdivision 3 of the Mounds View Zoning <br />Code, fences in front yards shall not exceed four feet in height; and, <br /> <br /> WHEREAS, the Mounds View City Council believes the installation of eight-foot tall <br />fences in certain situations would serve to benefit the health, safety and well-being of residents by <br />providing for additional screening, protection and privacy; and, <br /> <br /> WHEREAS, the City Council has the authority, pursuant to Section 3.06 of the City of <br />Mounds View City Charter and Minnesota Statutes Section 462.355, Subdivision 4, to adopt an <br />emergency ordinance which would allow for immediate adoption and effectiveness; and, <br /> <br /> WHEREAS, The Mounds View City Council believes that passage of this emergency <br />ordinance is necessary to protect the public health, safety and welfare of its residents; and, <br /> <br /> <br />NOW, THEREFORE, based on the above findings of fact, <br /> <br />THE CITY OF MOUNDS VIEW ORDAINS: <br /> <br /> <br /> SECTION 1. Chapter 1103, Section 1103.08, Subdivision 3 of the Mounds View Zoning <br />Code is hereby amended with additions underlined to read as follows:
