The applicant shall apply for and successfully obtain a variance from Section <br />1008.08, Subd. 10c of the Sign Code within 60 days of City Council <br />approval. If said variance request is denied, the applicant shall be <br />allowed installation of only one billboard subject to the siting <br />requirements outlined in the Sign Code. <br /> <br />3. Subject to the above stipulation, the locations of the proposed billboards shall <br />be as generally indicated on Exhibit A, attached to this resolution. <br /> <br />4. The applicant and the owner shall consider adding a clause to the lease <br />agreement which states that the Lessee will refuse objectionable <br />advertising content such as tobacco products, alcoholic beverages and <br />gambling. <br /> <br />5. If the applicant is unable to obtain the requisite billboard permits <br />from the Minnesota Department of Transportation, the interim use permit <br />should be considered null and void. <br /> <br />6. The applicant shall record or arrange to have recorded a copy of the City <br />Council resolution of approval with Ramsey County, within 60 days of <br />final action on this request, or the interim use permit shall be considered <br />null and void. <br /> <br />BE IT FURTHER RESOLVED that this interim use permit shall expire <br />on July 1, 2015 or at such time that the billboards become abandoned or remain <br />unused for a period of more than six months. <br /> <br />BE IT FINALLY RESOLVED that the Planning Commission directs staff <br />to forward this resolution to the City Council prior to approval of the minutes. <br /> <br />Adopted this 15th day of March, 2000. <br /> <br /> <br />_______________________ <br />__________ <br />Jerry Peterson, Chairperson <br /> <br />ATTEST <br />_______________________ <br />____________ <br />Rick Jopke, Community <br />Development Director <br /> <br /> <br />(SEAL)
