Ms. Carlson indicated in her memo of <br />December 3,1999 that she had concerns about whether the City could terminate health <br />care benefits after an employee had been on workers’ compensation leave for six <br />months. <br /> <br />Upon further review and consultation with the League of Minnesota Cities’ legal staff, it <br />has been determined that the subparagraph under Section 2.15 entitled “Insurance <br />Continuation” should be deleted. Said subparagraph provides that “An employee on <br />workers’ compensation will continue to receive their existing health care benefits (health <br />and life) for up to six months.” It has also been recommended that Section 2.10M, <br />which makes reference to “Insurance Continuation”, be deleted as well. <br /> <br />The City is being advised by Ms. Carlson that it cannot establish a blanket policy for <br />terminating the benefits of employees who are on workers’ compensation leave. Such <br />situations must be addressed on a case-by-case basis. <br /> <br />RECOMMENDATION: <br /> <br />Adopt Resolution 5411 removing from the Personnel Policy Manual the subparagraphs <br />under Section 2.15 and Section 2.10M entitled “Insurance Continuation”. <br /> <br /> <br />_______________________________________ <br />Givonna Reed, Assistant to the City Administrator <br /> <br /> <br /> <br /> <br /> <br />
