Agreement <br />Date of Report: August 29, 2018 <br /> <br />Issues related to the repair and maintenance of the underground utilities, in particular the storm <br />sewer, in the Silver Lake Woods Condominium Association have yet to be resolved by the <br />parties involved. Staff has researched the City’s files for the project and County files for any <br />easements or possible dedications of utilities that may be of record, which might shed some light <br />on resolving this issue. No documentation has been found that states that the utilities have ever <br />been dedicated to the City of Mounds View for public use. <br /> <br />The contention of the Association is that the City should make the repairs and continue to <br />maintain all the utilities within the development. Barring any wholesale abandonment of the <br />agreement that was adopted in 1993, for lack of resolution, staff’s recommendation remains the <br />Association should make the repairs to the storm sewer system. If the Association wishes to <br />dedicate the underground utilities to the City, staff recommends that the repairs should be <br />performed at the expense of the Association, an inspection of the remaining utilities should be <br />performed and any additional maintenance requirements that are discovered are repaired, prior to <br />the City accepting the utilities as public. All of the associated expenses to perform these services <br />should be born by the Association. The Association would also be responsible for legal expenses <br />related to the dedication and the proper filing of the documents. These are the recommendations <br />of staff and may not reflect the direction of Council.
