He stated a <br />performance bond in the amount of $25,000 would be a better <br />option. <br />City Attorney Karney asked the Mayor if he should change <br />the development agreement to a $25,000 performance bond rather <br />than the $5,000 cash deposit. <br />Samantha Orduno, City Administrator, stated that the owner <br />wants to get moving on this project because the people who <br />had to move out due to the fire want to move back in to their <br />homes. <br />City Attorney again stated that in checking with Rick Jarson, <br />Jarson felt that $5,000 would be sufficient. Barney felt that <br />by having the cash in hand if the owner did not fulfill the <br />City's expectations of building a handicapped unit, the City <br />would have the cash to entertain a lawsuit against the homeowner. <br />Rarney stated, in his opinion, it would be better to have the <br />cash in hand rather than place it on the City's tax roles. <br />Councilmember Quick stated that perhaps the City should ask <br />for both the $25,000 performance bond and the $5,000 cash <br />deposit. <br />Orduno inquired if the Council would like the wording in the <br />development agreement to be $25,000 rather than the $5,000 <br />cash deposit. <br />Councilmember Wuori inquired if the handicapped unit is <br />being placed into an existing empty apartment or is the <br />owner keeping someone out in oxder to build this unit? <br />Orduno stated thae handicapped accessible apartment is currently <br />rented but the person would be moved into the <br />reconstructed building and then construction would begin <br />on the handicapped accessible apartment. <br />MOTION/SECOND: Linke/Rickaby to approve the development <br />agreement changing the deposit from $5,000 cash to a <br />$25,000 performance bond. <br />5 ayes 0 nays Motion Carried <br />Samantha Orduno, City Administrator, listed the following <br />meetings for the next two weeks: <br />1.
