ORDINANCE NO. 667 <br /> <br /> <br /> AMENDMENT OF EMERGENCY INTERIM ORDINANCE NO. 653, TO EXTEND REGULATION OF <br />THE PRESENCE AND SITING OF TATTOO, BODY PIERCING, BODY BRANDING, BODY <br />PAINTING AND RELATED ESTABLISHMENTS WITHIN THE CITY OF MOUNDS VIEW. <br /> <br /> WHEREAS, the City Council continues to consider the issue of whether the City should adopt an <br />ordinance to address the City health and safety issues caused by tattoo, body piercing, body branding, body painting <br />and related establishments within the City; and <br /> <br /> WHEREAS, City staff has made an initial review of this matter and recommends that this matter be more <br />fully studied; and <br /> <br /> WHEREAS, the City Council has adopted, pursuant to Section 3.06 of the City of Mounds View City <br />Charter and Minnesota Statutes Section 462.355, Subdivision 4, a six (6) month emergency interim ordinance, <br />Ordinance No. 653, during which time the City has begun study of the possibility of adopting new or amended <br />controls to fulfill the City's legal obligation to adequately protect the public health, safety and welfare; and <br /> <br /> WHEREAS, the City’s study and consideration is not complete and extension of such emergency interim <br />ordinance for three (3) months is necessary to protect the public health, safety and welfare because no land use <br />controls or regulations exist for tattoo, body piercing, body branding, body painting and related establishments <br />within the City; and <br /> <br /> WHEREAS, the City Council authorizes continuation of a study as to the possibility of adopting new or <br />amended controls to fulfill the City's legal obligation to adequately protect the public health, safety and welfare; and <br /> <br /> WHEREAS, the City Council makes the following: <br /> <br /> FINDINGS OF FACT: <br /> <br /> 1. The City Council authorizes continuation of a study to be conducted for the purpose of <br />considering the adoption of new or amended land use controls or regulations as defined in Minn. <br />Stat. § 462.352, for tattoo, body piercing, body branding, body painting and related <br />establishments within the City of Mounds View. <br /> <br />2. The City Council of the City of Mounds View directs the City of Mounds View Planning <br />Commission to continue to conduct a study of this matter and make recommendations as to the <br />adoption of amended official controls or regulations to fulfill the City's legal obligation to <br />adequately protect the public health, safety and welfare. <br /> <br /> 3. Extension of the emergency interim ordinance, Ordinance 653, for a period of three (3) months <br />is to protect the health, safety and welfare of the City of Mounds View residents and to protect <br />the planning process, because no land use controls or regulations exist for tattoo, body piercing, <br />body branding, body painting and related establishments within the City, and not to delay or <br />prevent any single project. <br /> <br />NOW, THEREFORE, based on the above findings of fact, <br /> <br /> <br />THE CITY OF MOUNDS VIEW ORDAINS: <br /> <br />SECTION 1. The City of Mounds View Municipal Code Appendix D is hereby amended to include reference to the <br />following emergency Special Ordinance Nos. 653 and 667. <br /> <br /> Subdivision 1. Purpose. To protect the planning process under the authority of Minnesota <br />Statutes, Section 462.355, Subdivision 4, and to protect the public health, safety and welfare of the citizens of the <br />City of Mounds View, the City Council of the City of Mounds View hereby amends the interim ordinance, <br />Ordinance 653, which prohibits the presence and siting of any new, or the expansion of any existing, tattoo, body
