Unique circumstances apply to the property which do not apply to other properties in the <br />same zone or vicinity and result from lot size or shape, topography or other <br />circumstances over which the owner of the property since the enactment of this Title has <br />had no control. The unique circumstances do not result from the actions of the applicant. <br /> <br />Finding: Unique circumstances of this property include the use of the property as a <br />Police Department and its requirement of a secured area around its Sally <br />Port, together with the adjoining use of a City Hall and park, open for <br />public use and enjoyment. To protect the public’s health and safety, a 72” <br />tall fence provides a minimal separation between public areas and police <br />activities. <br /> <br /> e. The variance does not alter the essential character of the neighborhood. <br /> <br />Finding: The Variance does not alter the essential character of the neighborhood. <br />The property (City Hall Park) includes chain-link fences of various <br />heights. The property across the street (Community Center) includes a <br />72” chain-link fence in a front yard for use by a daycare. <br /> <br /> f. The variance requested is the minimum variance which would alleviate the practical <br />difficulties. Economic conditions alone do not constitute practical difficulties. <br /> <br />Finding: A 72” fence is the minimum height necessary to deter trespassers, and <br />protect the public. <br /> <br />NOW, THEREFORE, BE IT FINALLY RESOLVED, the Mounds View Planning <br />Commission, based upon the above findings, approves the Variance request of the City of <br />Mounds View (property owner) to increase the maximum fence height in a front yard, from 48” <br />to 72”, for property at 2401 Mounds View Blvd., subject to the following conditions: <br /> <br />1.
