(8) Adequate utilities, access roads, drainage and necessary facilities have been or will be <br />provided. <br /> <br />The continued use of the tent should not impact existing site conditions. <br /> <br />Public Hearing <br />A Public Hearing will be held by the City Council on March 28, 2016, as required by ordinance. <br />Notification was published in the Sun Focus on March 11, 2016, and will be mailed to property <br />owners within 350’ of the property. <br /> <br />Summary <br />The applicant, Anderson Companies, LLP (dba The Mermaid) has requested an Interim Use <br />Permit (IUP) to continue use of the 40’ X 105’ tent for banquettes. The tent includes a <br />permanent structure with a fabric membrane that is installed seasonally. The tent will be used <br />no more than 6 months out of the year, and has been in use since 2004. The City previously <br />approved IUP’s in 2005, 2010, and 2011, each expiring after five years or if ownership changed. <br /> <br />Recommendation <br />Staff recommends approval of the IUP conditioned upon required items in the resolution. <br /> <br />The Planning Commission is requested to consider the following options: <br /> <br />1. Resolution 1046-16, approving the Interim Use Permit is attached if the Commission <br />chooses this action. <br /> <br />2. The Planning Commission may choose to deny the Interim Use Permit. If the Commission <br />chooses this option, Staff would need to be directed to draft a resolution of denial with <br />findings of fact appropriate to support the denial. <br /> <br />3. Table the request. If additional information is needed before a decision can be rendered or <br />if more discussion is needed, the Commission can simply move to table the request until <br />such information has been provided.
