These conditions may include, but are not limited to, the <br />following: <br /> <br />(1) Increasing the required lot size or yard dimension. <br />(2) Limiting the height, size or location of buildings. <br />(3) Controlling the location and number of vehicle access points. <br />(4) Increasing the street width. <br />(5) Increasing the number of required off-street parking spaces. <br />(6) Limiting the number, size, location or lighting of signs. <br />(7) Requiring diking, fencing, screening, landscaping or other facilities to protect <br />adjacent and nearby property. <br />(8) Designating sites for open space. <br /> <br />It is Staff’s opinion that the proposed use will not require any conditions beyond the <br />standards within the Ordinance. <br /> <br />Summary <br />The applicant, Garden City, LLC, has requested a CUP for Open or Outdoor Sales as <br />an Accessory Use to operate a temporary garden center in the parking lot of the <br />Mounds View Square shopping center. The garden center will operate annually, April – <br />August. A similar use operated from this location, 1996 – 2014. <br /> <br />Recommendation <br />Staff recommends approval of the Conditional Use Permit contingent upon complying <br />with the conditions in Resolution 1045-16. <br /> <br />The Planning Commission is requested to consider the following options: <br /> <br />1. Resolution 1045-16, approving the Conditional Use Permit is attached if the Commission <br />chooses this action. <br /> <br />2. The Planning Commission may choose to deny the Conditional Use Permit. If the <br />Commission chooses this option, Staff would need to be directed to draft a resolution of <br />denial with findings of fact appropriate to support the denial. <br /> <br />3. Table the request. If additional information is needed before a decision can be rendered or <br />if more discussion is needed, the Commission can simply move to table the request until <br />such information has been provided.
