Item No: 5A <br />Meeting Date: July 20, 2016 <br />Type of Business: Planning Case SP-202-16 <br /> <br />1 <br /> <br /> <br />To: Mounds View Planning Commission <br />From: Jon Sevald, Planner <br />Re: Consider Resolution 1054-16, a Resolution recommending approval of a Text <br />Amendment to the Mounds View Municipal Code, Chapters 1102, 1103, and <br />1106 relating to Accessory Dwelling Units. <br />Date: July 20, 2016 <br /> <br />Introduction <br />Accessory Dwelling Units (ADU) are similar to an apartment on the same lot as a <br />single-family home. An ADU may be attached to, or detached from the home. <br />Examples include a basement apartment, an apartment above an attached garage, or a <br />standalone building in the backyard. Currently, ADU’s are prohibited in all districts. <br />Staff occasionally receive inquiries if they are permitted. This topic was discussed by <br />the City Council on May 9, 2016, and by the Planning Commission on June 1st and July <br />6th, 2016. <br /> <br />Discussion <br />At the July 6th Planning Commission meeting, the Commission’s consensus included: <br /> <br />Permitted Use: If the ADU is located within an existing home and does not require <br />physical alteration of the home’s exterior, other than doors or windows. Examples <br />include; conversion of a basement, second floor, area above an attached garage, or if <br />the home was originally constructed with an ADU. <br /> <br />Conditional Use: If the ADU is located within an addition onto a home or accessory <br />building requiring physical alteration of the building’s exterior. Examples include an <br />addition onto a home, garage, or a standalone ADU. <br /> <br />Owner Occupied: Either the home or the ADU must be homesteaded and occupied by <br />the homeowner a majority of the year. <br /> <br />It is possible that the property may be “Relative Homestead”, meaning that it is <br />occupied by a relative of the homeowner rather than the homeowner themselves. In <br />Minneapolis, to counter this loophole, the City requires that the homeowner record a <br /> <br />M E M O <br />
