Resolution 1061-16 <br />November 16, 2016 <br />Page 2 <br /> <br />WHEREAS, the City of Mounds View City Code, Section 1125.02, Subd 2 provides <br />criteria for granting a Variance to provide relief to the landowner in those cases where the Code <br />imposes practical difficulties to the property owner in the use of the property owner’s land. A <br />Variance may be granted only in the event that all of the following circumstances exist; and, <br /> <br />NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning Commission <br />finds that the criteria as identified in Section 1125.02, Subd 2 are satisfied and finds there to be <br />sufficient practical difficulty with regards to the property located at 2466 Bronson Dr., and <br />makes the following findings of fact to its decision: <br /> <br />a. The Variance is in harmony with the general purposes and intent of this Title. <br /> <br />Finding: The Variance is in harmony with the general purposes and intent of <br />the City Code. <br /> <br />b. The Variance is consistent with the Comprehensive Plan; <br /> <br />Finding: The Variance is consistent with the Comprehensive Plan (2010); <br /> <br />General Land Use <br />Goal 4: Prevent development or redevelopment that does not <br />have a sufficient level of supportive and service <br />facilities (utilities, parking, access, etc.). <br /> <br />Policy a. Ensure that the intensification of land use activity and <br />development would have sufficient corresponding <br />increase in related supportive and service facilities <br />such as parks, off-street parking, loading, surface water <br />management, etc. <br /> <br />The requested Variance is specific to the proposed parking lot and <br />undevelopable land to be reserved for proof of parking along <br />Bronson Dr. An alternative to the requested Variance is to locate <br />this parking lot on land currently occupied by City Hall Park. If <br />park facilities were to be displaced, it would not be consistent with <br />the goals and policies of the Comprehensive Plan. The proposed <br />Public Works Facility expansion, and its associated parking lot, is <br />necessary to provide adequate public services to the community. <br /> <br />c. The applicant proposes to use the property in a reasonable manner not permitted <br />by this Title or the City Code. <br /> <br /> <br /> <br /> <br />
