<br />MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 1024-15 <br /> <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF AN AMENDMENT TO <br />TITLE 1100, CHAPTER 1112 OF THE MOUNDS VIEW ZONING CODE TO ADD <br />REQUIREMENTS FOR TEMPORARY OUTDOOR FOOD SALES; <br />SPECIAL PLANNING CASE 195-15 <br /> <br /> <br />WHEREAS, City staff has recommended that amendments be made to the <br />zoning code relating to temporary outdoor food sales; and, <br /> <br />WHEREAS, the Planning Commission agrees with the City Staff <br />recommendation that requirements specifically for temporary outdoor food sales should <br />be added; and, <br /> <br />WHEREAS, City staff has amended Chapter 1112.03 of the Mounds View City <br />Code by deleting the stricken language and adding the underlined text as follows: <br /> <br /> <br />1112.03: ACCESSORY USES: The following are permitted accessory uses in a B-1 <br />District: <br /> <br />Subd. 7. Temporary outdoor food sales as an accessory use and including sales in or <br />from motorized vehicles, trailers, or wagons, subject to the following: <br /> <br />a. The activity shall not continue on the same property for a period greater than <br />twenty-one (21) consecutive days. <br /> <br />b. Notwithstanding Article 13, Section 7 of the Minnesota Constitution, a <br />license issued by the City shall be obtained prior to commencing the activity. <br /> <br />c. A permit will not be issued without the written consent of the property owner. <br /> <br />d. The sales area shall be grassed or surfaced to control dust. <br /> <br />e. The activity shall not take up parking space as required for conformity of this <br />Title. <br /> <br />f. All lighting shall be hooded and so directed that the light source shall not be <br />visible from the public right-of-way or from neighboring residences and shall <br />be in compliance with Sections 1103.08 and 1103.09 of this Title.
