Item No: 6A <br />Meeting Date: December 4, 2013 <br />Type of Business: Other Planning Activity <br /> <br />City of Mounds View Staff Report <br />To: Mounds View Planning Commission <br />From: Heidi Heller, Planning Associate <br />Item Title/Subject: Discuss Proposed Code Amendment for Wetlands <br /> <br /> <br />Discussion: <br />Community Development staff was recently made aware of a detail in the City Code relating <br />to wetlands. Like most City Code chapters, the wetlands chapter includes language for <br />nonconforming buildings and parcels, and states that a variance is required if someone were <br />to build or rebuild on either a nonconforming parcel or building. A variance should be <br />required if a nonconforming building were to be expanded or rebuilt, but in this case, staff <br />feels that it is not necessary to require a variance to building on a nonconforming “parcel.” <br />There are other requirements and approvals needed when building in wetlands or wetland <br />buffer areas, so also requiring a variance seems unnecessary. <br /> <br />Staff recommends simply adding language to clarify that a variance would be required ONLY <br />for nonconforming buildings. <br /> <br /> <br />Recommendation: <br />Staff recommends that the Planning Commission review and discuss the information, and <br />provide staff with direction about the proposed amendment. <br /> <br /> <br />Respectfully submitted, <br /> Heidi Heller <br />Planning Associate <br /> <br /> <br />Attachments: <br />1.
