The variance would not be materially detrimental to the purpose of this Title or to other <br />property in the same zone. <br /> <br />Given the circumstances, granting the variance request may not be materially <br />detrimental to the purpose of this Title. <br /> <br />g. The proposed variance will not impair an adequate supply of light and air to adjacent <br />property or substantially increase the congestion of the public streets or increase the <br />danger of fire or endanger the public safety or substantially diminish or impair property <br />values within the neighborhood. <br /> <br />The garage will not impair an adequate supply of light or air to the adjoining properties. <br /> <br />Public Hearing: <br />As with any variance request, this request required a public hearing. City staff mailed notices <br />were to all property owners within 350 feet of the applicant’s property. Staff has received two <br />phone calls from residents concerned about the applicant running a motorcycle business and <br />noise. Staff spoke to the applicant and he does not run a business, nor does he plan to start <br />one. The motorcycle restoration he does is strictly a hobby, and he only has vintage <br />motorcycles, which do not have the loud exhaust pipes. <br /> <br />Recommendation: <br />City staff is recommending approval of the conditional use permit and variance as requested. <br /> <br />1. Resolutions 928-10 and 929-10, approving the conditional use permit and variance are <br />attached if the Commission chooses this action. <br /> <br />2. The Planning Commission may choose to deny either the conditional use permit or variance. <br /> If the Commission chooses this option, Staff would need direction from the Commission to <br />draft a resolution of denial with findings of fact appropriate to support the denial. <br /> <br />3. Table the request. If the Commission needs additional information before they make a <br />decision or if they decide there is a need for more discussion, the Commission can simply <br />move to table the request until such information has been provided. Because of 60-day <br />requirements, the Commission would need to act upon the request as soon as reasonably <br />possible to avoid an inadvertent approval. <br /> <br /> <br />Attachments: <br />1.
