KFC Sign Variance Report <br />March 4, 2009 <br />Page 4 <br />This variance request presents challenges for the City. It is unfortunate that the contractor <br />installed the signage on the building without getting City approval. Now that the signs are in <br />place, it is the opinion of staff that the proposed variance should not be detrimental to the <br />purpose and intent of the City Code. This is because the additional signage is on a <br />freestanding building on County Highway 10 and that some of the signage is not typical <br />advertising (as it has artwork and graphics and small amounts of lettering). <br />All of the City criteria, as indicated above, appear to be satisfied which would allow for the <br />granting of the variance. <br />Alternatives: <br />After holding the public hearing and taking testimony from staff, the applicant and nearby <br />property owners, the Commission can take one of the following actions related to the <br />request: <br />1. Approve the variance as requested. I have attached Resolution 899-09 for the <br />Commission's approval if that is the chosen course of action. <br />2. Deny the requested variance. To move forward with this option, the Commission should <br />move to direct staff to draft a resolution of denial with findings of fact appropriate to support <br />the denial. <br />3. Table the request. If the Commission needs more information before they make a decision <br />or if they need time for more discussion, the Commission can move to table the request until <br />such information has been provided. <br />Recommendation: <br />Approve Resolution 899-09 approving the requested sign variance for Kentucky Fried Chicken. <br />rf� <br />Ken Roberts — Community Development Director <br />Attachments: <br />1.
