This <br />report is about a proposed code amendment about the penalties for certain code violations. <br /> <br />Discussion: <br /> <br />Chapter 1125 is the Administration and Enforcement part of Title 1100 (Zoning Code) of the <br />City Code. The prosecuting City Attorney (Tom Hughes) has advised Jeremiah Anderson that <br />the City should amend Section 1125.06 of the Code. (Please see the attached e-mail from <br />2008). The attorney told City staff that this change is necessary because the current City Code <br />language about penalties is not as clear or as strong as it should be. <br /> <br />The current code language reads as follows: <br /> <br />1125.06 PENALTIES: Any person who violates any provision of the Code shall, <br />upon conviction thereof, be fined as provided in Section 104.01 of the Code. Each day a <br />violation is permitted to exist shall constitute a separate offense. <br /> <br />Staff has prepared an amendment to the City Code to make Section 1125.06 about penalties <br />clearer, stronger and more consistent with other penalty sections of the City Code. <br /> <br />Recommendation: <br /> <br />Staff recommends that the Planning Commission review and discuss Resolution 912-09. <br /> <br />Respectfully submitted, <br /> <br /> <br /> <br /> <br />Ken Roberts – Community Development Director <br />Attachments: <br />1.
