<br />Mermaid Staff Report <br />October 1, 2008 <br />Page 2 <br /> <br /> <br />Easements: The City’s Subdivision Code requires that plats dedicate perimeter drainage and <br />utility easements for each lot in the subdivision. This plat already has the required perimeter <br />easements around the current Mermaid property, and staff does not believe that adding <br />additional easements along the new property lines running through the parking lot are <br />necessary. <br /> <br />Streets: No new or altered streets or access drives into the Mermaid site are being proposed. <br /> <br />Park Dedication Requirements: The Subdivision Code indicates that any subdivision of land is <br />subject to a park dedication fee. In this case, the City typically sets the fee as equal to 10% of <br />the market value of the land. Staff uses Ramsey County assessed values as the basis for <br />dedication computation. In 2000 when the PUD was approved, a park dedication fee was paid. <br /> Staff recommends that the fee only be based on the difference in the land value between 2000 <br />and 2008, and only on the retail lot. This fee amount should be determined by the City <br />Council. <br /> <br />Major Subdivision Summary: <br />The Mermaid is currently zoned PUD, Planned Unit Development, and the proposed 3-lot <br />subdivision would be consistent with the existing zoning of the property. One of the proposed <br />property lines would separate the Mermaid from the hotel. The building code may require <br />additional firewall construction between the structures to have each building on it’s own lot. <br />The submitted revised plat appears to meet city and building code requirements and is now <br />being reviewed by the city attorney and building official/fire marshall. <br /> <br />Deadline for Action: <br />The original application was accepted by the City on August 25, 2008 and in accordance with <br />MN Statute 15.99, a decision shall be made within 60 days of application acceptance. The <br />deadline for action for this request is December 23, 2008, since the City exercised its option <br />to extend the timeline for an additional 60 days. <br /> <br />Alternatives: <br />The Planning Commission should review the plans and discuss the revised preliminary plat. The <br />Planning Commission may take one of the following actions related to the Preliminary Plat <br />request: <br /> <br />1. Approve the revised Preliminary Plat as requested. <br /> <br />2. Deny the request. To consider this option, the Commission will need to direct staff to <br />prepare a resolution with findings of fact to support the denial recommendation. <br /> <br />3. Table action on the request. This option would be appropriate if the Planning <br />Commission should need additional information or more input before a decision can be <br />made.
