<br />Item No: 6A <br />Meeting Date: Jan 10, 2007 <br />Type of Business: Commission Business <br />City of Mounds View Staff Report <br /> <br /> <br /> <br />To: Mounds View Planning Commission <br />From: James Ericson, Community Development Director <br />Item Title/Subject: Consideration of a Minor Subdivision of 8184 Eastwood <br />Road; Planning Case MI06-002 <br /> <br />Introduction: <br /> <br />Abiding Savior Church is the owner of the single family dwelling located at 8184 Eastwood <br />Road and they have submitted a minor subdivision request to split the home and 16,025 <br />square feet from the parcel leaving a flag-shaped lot that would be absorbed into the Church’s <br />land at the corner of Red Oak Drive and Ardan Avenue. The basis for the request is that the <br />Church would like to expand their acreage to allow for a senior residential facility to be built on <br />the site. (An application has been submitted by Bradford Development of Mankato on behalf <br />of Abiding Savior requesting a rezoning, comp plan amendment, development review and <br />conditional use permit for the project, which will be addressed by the Planning Commission in <br />February.) Keeping in mind the future plans of the Church, this minor subdivision application <br />should be reviewed and considered on its own merits and according to the Subdivision Code <br />(Title 1200) requirements 1. <br /> <br />Abiding Savior has submitted a certificate of survey (attached) which illustrates the proposed <br />subdivision of 8184 Eastwood Road and have submitted the necessary title commitment <br />which has been forwarded to the City Attorney for review. <br /> <br />Discussion: <br /> <br />A minor subdivision is a division of land less than two acres in area in which no more than <br />one additional lot is created. The lot at 8184 Eastwood Road is zoned R-1, Single Family <br />Residential and the Comprehensive Plan designates this area for low density residential. The <br />minimum lot width for interior residential parcels is 75 feet and the minimum lot area is 11,000 <br />square feet. After the proposed subdivision, the house would be situated on a 16,025 square <br />foot lot with 90.54 feet of frontage on Eastwood Road, both consistent with City Code. The <br />“created” lot would not be consistent with the minimum requirements however due to only <br />10.72 feet of frontage on Eastwood Road. Due to the potential for future redevelopment, the <br />noncompliance may be permitted subject to resolving the inconsistencies within a certain time <br />frame—one year, for example. Church representatives have indicated that the only reason <br />the lot was not split cleanly in two (maintaining the 10.72 foot wide strip to Eastwood Road) <br />was to preserve a the row of mature pine trees in that strip. (Please refer to the photos later <br />in this report for reference.) There is a shed which is shown to be straddling the proposed lot <br />line—this building would need to be moved or removed if it has not been addressed already. <br />Aside from the above, all setbacks and minimum requirements are satisfied with this request. <br /> <br />1 For the benefit of new Planning Commission members, the entirety of the Subdivision Code is attached to the staff <br />report.
