Item No: 6A <br />Meeting Date: August 22,2007 <br />Type of Business: Action <br /> <br /> <br />City of Mounds View Staff Report <br /> <br />To: Planning Commission Members <br />From: Heidi Heller, Planning Associate <br />Date: August 16, 2007 <br />Item Title/Subject: Request for a Variance Extension by Tyson Company at 4825 <br />Mustang Circle <br /> <br /> <br />In 2006, Tyson Company applied for a development review and a variance to build an additional <br />building on their property. The variance request was for reduced front building and parking <br />setbacks – 10 foot building setback and 5 foot parking setback. Due to the large wetland area in <br />the rear of the property, the proposed building and parking lot were pushed much closer to the <br />street than the 40 feet that code requires. On August 2, 2006, the Planning Commission approved <br />a variance for these reduced setbacks (Resolution 848-06). <br /> <br />Per City Code Chapter 1125.02 Subd. 5, all variances must be acted on within one year from the <br />date of approval or they will become null and void, unless an extension is granted by the Planning <br />Commission. The applicant, Tyson Company, has submitted a written request for a one year <br />extension. <br /> <br />Soon after the variance was granted, Tyson began working with Ferrellgas to possibly locate on <br />Tyson’s property, and then decided that the cost of constructing a new building was too high and <br />that they were not going to proceed with their own expansion plans. The new site plan showing <br />where Ferrellgas would be located, is exactly where Tyson planned their new building to be. <br />Tyson has now said that construction costs have come down and if Ferrellgas doesn’t locate on <br />their property, they would probably move forward with new building plans again. <br /> <br /> <br />Recommendation <br /> <br />Consider a one year extension of a variance for reduced building and parking setbacks at Tyson <br />Company, 4825 Mustang Circle.
