Item No: 5A <br />Meeting Date: April 19, 2006 <br />Type of Business: Action <br />City of Mounds View Staff Report <br />To: Mounds View Planning Commission <br />From: James Ericson, Community Development Director <br />Item Title/Subject: Consideration of a Conditional Use Permit for an Over- <br />size Garage at 8495 Sunnyside Road <br /> <br />Introduction: <br /> <br />The applicants, Don and Diane Balk, reside at 8478 Long Lake Road and own the vacant lot <br />adjacent to the west at the corner of Long Lake Road (formerly County Road J) and <br />Sunnyside Road. The Balks would like to build a new home on the vacant lot and sell their <br />old home. A conditional use permit is required because the Balks have a recreational <br />vehicle that they would like to park inside the garage, and in so doing, had to expand the <br />footprint of the garage to 1,062 square feet. The maximum sized garage permissible without <br />a CUP is 952 square feet. Without the extra depth needed for the RV (an additional nine <br />feet) the garage would not necessitate a CUP. <br /> <br /> <br />Discussion: <br /> <br />Section 1106.4, Subdivision 6, lists the specific conditional use permit requirements for <br />garages larger than 952 square feet. These requirements, such as setbacks and maximum <br />square-footage are all satisfied with this proposal. The setback for an attached garage is five <br />feet; the applicants are proposing to construct the garage six feet from the south side <br />property line and 30 feet from the front lot line, matching the setback of the home to the <br />south of the vacant lot. The Code sets an upper limit of accessory storage space on a <br />property at 1,800 square feet. The square footage of the proposed garage is 1,062 square <br />feet, which would still allow for a shed to be constructed at some point in the future, if the <br />applicants so desired. <br /> <br />Adverse Effects & CUP Requirements <br /> <br />As is the case with every conditional use permit application, the Planning Commission is <br />required to consider the possible adverse effects of the proposed conditional use. The <br />findings of the Planning Commission shall be based upon, but not limited to, the following <br />factors: <br /> <br />• Relationship with the Comprehensive Plan. <br />• The Geographical Area Involved <br />• Whether such use will tend to or actually depreciate the area in which it is <br />proposed. <br />• The Character of the Surrounding Area <br />• The demonstrated need for such a use. <br />
