<br />ORDINANCE NO. 774 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br /> <br />AN ORDINANCE AMENDING MOUNDS VIEW CITY CODE CHAPTERS <br />701 AND 1106 RELATING TO “DOG KENNELS” <br /> <br />THE CITY OF MOUNDS VIEW DOES HEREBY ORDAIN: <br /> <br />SECTION 1. Section 701.04, Subd. 8 of the Mounds View Municipal Code pertaining to <br />Kennels is hereby amended with the proposed additions underlined and deletions struck out <br />to read as follows: <br /> <br />Subd. 8. Kennels: <br /> <br />a. Licensing requirements: All dog kennels must first obtain a special use permit as <br />required in Title 1100 of this Code. The zoning classifications as required under <br />Chapter 1103 and Section 1104.02 of this Code must be conformed with. Regardless <br />of any provision in Title 1100 of this Code, the The owner of a proposed dog kennel <br />shall submit a license application and present a petition to the Clerk / Administrator <br />Council signed by more than fifty percent (50%) of all registered landowners or those <br />occupying land within five hundred feet (500’) of the proposed kennel who agree to the <br />establishment of the kennel. The petition shall contain, among other items of <br />information, the number and species of dogs intended to be kept on the <br />premises, whether the yard or kennel area is or will be fenced and whether the <br />dogs would be raised for breeding purposes. Upon the receipt of the petition and <br />license application, the Clerk / Administrator shall present such said petition and <br />application to the City Council for their consideration. Council will then set a <br />hearing for a special use permit, as provided for in Title 1100 of this Code. The petition <br />shall contain, among other items of information, how many dogs the petitioner intends <br />to keep on the premises. (Ord. 696, 4-22-02) <br /> <br />b. License fee: The annual license fee for dog kennels shall be established by <br />resolution of the City Council. The license fees are due September 1 of each year. <br />(Ord. 696, 4-22-02) <br /> <br />c. Cleanliness and order; nuisance declared: Kennels and the premises around the <br />kennel shall be kept in a clean, quiet, orderly and sanitary condition so as not to <br />constitute a nuisance as defined in Chapter 607 of this Code and in Minnesota <br />Statutes, Section 561.01. In determining whether a nuisance exists, consideration shall <br />be given to the kennel’s location, location of other residences, and general character of <br />the neighborhood. <br /> <br />d. Revocation: A kennel license may be revoked by action of the Council for just <br />cause after providing the license holder with an opportunity to be heard. Just <br />cause shall include any violations of this Code reasonably related to the <br />operation of the dog kennel and/or treatment of animals. <br />Exhibit A
