City Council Agenda: Upon receiving the report and recommendation of the Planning <br />and Zoning Commission and the City staff, the City Council shall place the report and <br />recommendation on the agenda for the next regular meeting. Such reports and <br />recommendations shall be entered in and made part of the permanent written record of the <br />City Council meeting. <br /> <br /> i. Public Hearing: Upon receiving the report and recommendation of the Planning and <br />Zoning Commission and the City staff, the City Council shall hold a public hearing in <br />compliance with Minnesota Statutes, section 462.357, subdivision 3 and shall make a <br />recorded finding of fact and shall impose any conditions it considers necessary to protect the <br />public health, safety and welfare. <br /> <br /> j. Four-Fifths Vote: Amendments of this Title, the Official Zoning Map or Four a <br />conditional use permit shall require passage by a four-fifths (4/5) vote of the full City <br />Council. <br /> <br /> k. Notification of Decision: The City Clerk-Administrator shall notify the applicant of the <br />Council's decision, in writing. <br /> <br />Subd. 2. Initiation of Amendments: The City Council or Planning and Zoning Commission may, <br />upon its own motion, initiate a request to amend this Title or the Official Zoning Map. Any <br />person owning real estate within the City may initiate a request to amend this Title or the <br />Official Zoning Map as it affects the real estate owned by said person. <br /> <br />Subd. 3. Conditional Use Permit: <br /> <br /> a. Purpose: The purpose of a conditional use permit is to provide the City with a reasonable <br />degree of discretion in determining the suitability of certain designated uses upon the <br />general welfare, public health and safety. <br /> <br /> b. Criteria for Granting Conditional Use Permits: In granting a conditional use permit, the <br />City Council shall consider the advice and recommendations of the Planning and Zoning <br />Commission and the effect of the proposed use on the Comprehensive Plan and upon the <br />health, safety and general welfare of occupants of surrounding lands. Among other things, <br />the City Council shall make the following findings where applicable: <br /> <br /> (1) The use will not create an excessive burden on existing parks, schools, streets <br />and other public facilities and utilities which serve or are proposed to serve the area. <br /> <br /> (2) The use will be sufficiently compatible or separated by distance or screening <br />from adjacent residentially zoned or used land so that existing homes will not be depreciated <br />in value and there will be no deterrence to development of vacant land.
