<br />Busch Variance & CUP Report <br />December 6, 2006 <br />Page 5 <br /> <br /> <br />Deadline for Action: <br />This application was accepted on November 15, 2006 and in accordance with MN Statute <br />15.99, a decision shall be made within 60 days of application acceptance. The deadline for <br />action for these two requests is January 14, 2007. <br /> <br />Recommendation: <br /> <br />After holding the public hearing and taking testimony from staff, the property owner and <br />affected neighbors, the Commission can take two of the following actions related to the <br />request: <br /> <br />1. Approve the Variance as requested. Resolution 854-06 is attached if the Commission <br />chooses this course of action. <br /> <br />2. Approve the Conditional Use Permit as requested. Resolution 855-06 is attached if the <br />Commission chooses this course of action. <br /> <br />3. Deny the requested variance and/or conditional use permit. To move forward with this <br />option, the Commission should direct staff to draft resolutions of denial with findings of fact <br />appropriate to support the denial. <br /> <br />4. Table one or both of the requests.
