Miller Variance Request <br />July 6, 2005 <br />Page 3 <br /> <br />Recommendation: <br /> <br />After holding the public hearing and taking testimony from staff, the applicant and affected <br />neighbors, the Commission can take one of the following actions related to the request: <br /> <br />1. Approve the variance as requested. While staff supports approval of this request, no <br />resolution has been prepared to effectuate an approval. The applicants will need to <br />submit a detailed site plan showing the proposed expansion and all distances to property <br />lines. Because of the extent of the encroachment, staff would recommend that a <br />professional boundary survey be conducted to determine with certainty the extent of the <br />variance requested. In lieu of a survey prepared by a certified land surveyor, staff would <br />accept a detailed, to-scale site plan prepared by the applicants. <br /> <br />2. Deny the request given that the home already encroaches into the front setback. To <br />consider this option, the Commission will need to direct staff to prepare a resolution of <br />denial with findings of fact to support the denial. <br /> <br />3.
