<br />Item No: 5 <br />Meeting Date: October 6, 2004 <br />Type of Business: Commission Business <br />City of Mounds View Staff Report <br />To: Mounds View Planning Commission <br />From: Kristin Prososki, Planning Associate <br />Item Title/Subject: Final Approval of an Administrative Variance for a <br />Reduced Rear Yard Setback at 7717 Long Lake Road; <br />Planning Case AV2004-002 <br /> <br /> <br />Introduction: <br /> <br />The applicant, The Phoenix Residence, is proposing to construct a single-family home that <br />would serve six adults with developmental and physical disabilities. The home would be <br />located at 7717 Long Lake Road. Mounds View Zoning Code requires a thirty (30) foot rear <br />setback. The requested variance is for a twenty-five (25) foot rear setback. This property <br />was granted a front setback variance by the Planning Commission on April 21, 2004. <br /> <br /> <br />Discussion: <br /> <br />Staff reviewed this request and determined that it qualified for an administrative variance, as <br />it is within 25% of setback requirements. Staff reviewed the proposed site plan and spoke <br />with the applicant about the hardship claim. The hardship for the rear setback request is that <br />the lot is of substandard size and that the buildable area of the lot is very limited. The lot is <br />located on the corner of County Road I and Long Lake Road and has only ninety-four feet of <br />frontage on County Road I. The Mounds View Zoning Code requires that corner lots have a <br />minimum of one hundred feet of frontage on both street fronts. <br /> <br />Due to the fact that it is a corner lot, the property is required to have two front setbacks, <br />which in this case are thirty feet from County Road I and thirty-two feet from Long Lake <br />Road. In addition, the home must maintain a ten-foot side yard setback (from the east <br />property line) and a thirty-foot rear setback (from the north property line). The applicant is <br />requesting a twenty-five foot rear (north) setback in order to fit the one level, handicapped <br />accessible home that they are proposing to construct on the lot. There is a twenty-five foot <br />drainage and utility easement on the north side of the property, which the proposed home <br />would not encroach into. <br /> <br />Staff feels that there is sufficient hardship to warrant a variance. Staff also considered any <br />negative affects that the proposed setback might have on the surrounding area and found <br />that the house would not negatively impact the neighborhood. The Community Development <br />Director granted preliminary approval. The adjacent neighbors have been notified of the <br />variance request. One of the adjacent neighbors spoke with Staff about this request. The <br />neighbor simply wanted to see a copy of the proposed site plan and did not oppose the <br />administrative variance. <br /> <br /> <br /> <br />
