Item No: 07 <br />Meeting Date: April 16, 2003 <br />Type of Business: Discussion <br />City of Mounds View Staff Report <br />To: Mounds View Planning Commission <br />From: James Ericson, Acting City Administrator <br />Item Title/Subject: Consideration of a Possible Amendment to the Zoning <br />Code Relating to Expansions of Existing Multi-Family <br />Residential Structures <br /> <br />Introduction: <br /> <br />At the Planning Commission’s last meeting, I reported that the City Council was interested in <br />having the Planning Commission review the Zoning Code and make a recommendation that <br />would either restrict or control the process by which an existing multi-family residential <br />development could expand. I explained that the method by which control could be exercised <br />is by requiring all existing developments to go through a conditional use process to expand <br />density (the number of individual dwelling units.) <br /> <br />Discussion: <br /> <br />Last year, the City recently adopted a change to the Zoning Code pertaining to townhomes <br />and multi-family developments. The change, effectuated by Ordinance 698, removed CUP <br />requirements on townhomes, and instituted CUP requirements for multi-family <br />developments. The difference between the two can be defined as follows: Townhomes are <br />individually owned and occupied on individual lots, whereas multifamily dwellings are <br />typically rental units on one parcel. (That does not preclude, however, townhomes from <br />being rented.) Since multi-family dwellings are now considered a conditional use in either <br />the R-3 and R-4 Zoning districts, it could be as simple as adding one line in both districts <br />which require that all existing complexes go through a CUP to expand density: <br /> <br />Multi-Family developments having been constructed prior to January 1, 2003 shall <br />first obtain a Conditional Use Permit (CUP) prior to expanding the number of <br />dwelling units or the principal building footprint. In addition to the criteria outlined <br />in Section 1125, all zoning, building and parking requirements shall be satisfied as <br />a condition of approval. <br /> <br />Recommendation: <br /> <br />Please consider the above language and discuss whether it or different language would <br />accomplish the goal of controlling multi-family expansion. Based on the Commission’s <br />direction, I can draft an ordinance and resolution for your action on May 7, 2003. <br /> <br /> <br />_____________________________________ <br />James Ericson <br />Interim City Administrator
