<br />Goettsch PC Report <br />June 18, 2003 <br />Page 2 <br /> <br />Adverse Effects <br /> <br />According to the City Code, the Planning Commission must consider the possible adverse <br />effects of the proposed conditional use. The findings of the Planning Commission shall be <br />based upon, but not limited to, the following factors: <br /> <br />• Relationship with the Comprehensive Plan. <br />• The Geographical Area Involved <br />• Whether such use will tend to or actually depreciate the area in which it is proposed. <br />• The Character of the Surrounding Area <br />• The demonstrated need for such a use. <br /> <br />As stated on the previous page, the proposed request fully complies with the Comprehensive <br />Plan. The neighborhood has many lots of this same size and the proposed garage satisfies <br />the maximum rear yard coverage threshold, which was established to ensure that 80% of all <br />backyard areas would remain greenspace. While the proposed garage will be 448 square <br />feet larger than the existing garage, neither property to the north or south should be <br />impacted by the proposal. A privacy fence buffers the property to the south and the property <br />to the north has its garage along the common property line. The properties to the rear would <br />be most visually impacted by the proposed garage however it will be less than three feet <br />wider than the original garage so it should “appear” only slightly larger from a profile <br />perspective. From the front view, relocating the RV that is currently parked on the driveway <br />into the new garage would be an improvement everyone would notice. <br /> <br />The garage would not depreciate the area and in fact would bring added value to the <br />property and would have a positive impact to the tax base. While many homes in the area <br />still have the original, small garages, a growing number of properties in the area are making <br />similar improvements. As for demonstrated need for such a use, I have visited the property <br />and can personally testify as to the Goettsch’s need for the additional space. <br /> <br />Code Consistency <br /> <br />Subdivision 6 of Section 1106.04 lists the conditions under which a conditional use permit <br />can be issued. These are as follows: <br /> <br />a. The accessory building must conform with Section 1103.06 and subdivision 1106.03(l) <br />of this Title. <br /> <br />b. The combined square footage of all accessory buildings on one (1) lot cannot exceed <br />one thousand eight hundred (1,800) square feet. <br /> <br />c. The building shall be designed and maintained to provide a uniform appearance with <br />the dwelling unit. <br /> <br />d. The width of the building cannot exceed thirty-five feet (35'). <br /> <br />e. The building shall be a permanent structure. <br /> <br />f. Should the use for which the permit was granted be changed, the permit shall be <br />subject to reconsideration, revocation or other action regulated by Code. <br />
