MEMO TO: MAYOR AND COUNCIL <br /> FROM: CLERK-ADMINISTRATOR 11*.� <br /> , --s <br /> DATE: DECEMBER 27 , 1985 <br /> SUBJECT: CHARTER AMENDMENT <br /> On May 21 of 1985 a letter was sent from this office to <br /> Charter Commission Chairman Bill Doty , copy attached, which <br /> was copied to you requesting the consideration of the <br /> Charter Commisson for the amendment of the Charter to <br /> reflect revisions to the State Statute regarding the filing <br /> dates for local elective offices. <br /> On December 19 , 1985 the Charter Commission met and <br /> unanimously approved a motion recommending the amendment of <br /> the Charter to comply with these requirements. Attached is <br /> a copy of a letter from Charter Commission Chairman Doty to <br /> the Mayor and Council outlining the action taken by the <br /> Charter Commission. <br /> Finally , attached is a copy of Minnesota Statute 410. 121 , <br /> Subdivision 7 outlining the requirements of state law with <br /> respect to the amendment of a Charter. Subdivision 7 <br /> provides that upon recommendation of the Charter Commission <br /> the City Council may enact a Charter Amendment by ordinance <br /> if adopted by a unanimous vote and preceded by a public <br /> hearing. Also, the charter amendment does not go into <br /> effect until 90 days after its passage and publication <br /> assuming a referendum petition is not received within 60 <br /> days after the passage and publication. <br /> Staff would request Council consideration of Ordinance No. <br /> 404 amending Chapter 4, Section 4. 02, of the Home Rule <br /> Charter of the City of Mounds View. <br /> RECOMMENDATION: Staff would recommend that the Council <br /> schedule , by Consent Agenda, at your January 13 , 1986 <br /> meeting a public hearing for the evening of January 27 , <br /> 1986. Staff would also recommend the unanimous approval of <br /> this charter amendment by the City Council in order that our <br /> Home Rule Charter' s election requirements relating to the <br /> filing for local offices might comply with statutory <br /> requirements. <br /> DFP/mjs <br /> Attachments : <br />
