MEMO TO: MAYOR AND CITY COUNC L /1110 <br /> FROM: CLERK-ADMINISTRAT <br /> I • <br /> DATE: DECEMBER 27, 1989 <br /> SUBJECT: HOME RULE CHARTER <br /> At a recent social gathering Bob Toborg indicated a desire <br /> to meet with me regarding changes the staff would like to <br /> suggest be made in the Home Rule Charter . I indicated to <br /> Bob that prior to my meeting with him I would like to <br /> discuss the matter with the City Council and receive your <br /> approval . For that reason, I am writing this memorandum and <br /> requesting that we discuss this matter in detail . <br /> Should you approve of my meeting with Mr . Toborg, I would be <br /> suggesting to him two (2 ) changes to the Charter that I feel <br /> are necessary for the efficient operation of the City at <br /> this time. The first of these is an addition to Section <br /> 4. 05 of the Charter which addresses vacancies on the City <br /> Council . Currently, the filing dates for our special <br /> elections is identical to those for regular elections. As <br /> you recall, with our special election in the Spring of 1989, <br /> we were unable to hold the election for approximately 60 <br /> days due to the filing requirements contained in our Charter <br /> and State Law. It would be my recommendation that a <br /> shortened filing date be provided for for special elections <br /> to fill vacancies on the City Council in order to fill such <br /> vacancies in a more timely fashion. <br /> The second change that I would be recommending would be to <br /> provide for the adoption of the Long-Term Financial Plan by <br /> resolution rather than by ordinance as currently required <br /> under Section 7. 05. I would be recommending this because <br /> the Long-Term Financial Plan is a policy statement and <br /> planning documentfor the City, not a document that should <br /> become binding law. Since the Long-Term Financial Plan <br /> looks out five years and is frequently prepared prior to the <br /> adoption o - - . s .u.ge , even those projects for <br /> the next year are sometimes questionable until we become <br /> aware of the level of revenues we might be receiving. <br /> Should a resident of the City wish to challenge the City ' s <br /> non-compliance with the Long-Term Financial Plan, we would <br /> find ourselves in a very difficult position due to the fact <br /> that it is the law of the City, not a policy document. <br /> It would be my hope that we could discuss the aforementioned <br /> changes I would be recommending and any other thoughts you <br /> might have with regard to the Charter prior to any meeting <br /> you might approve of me having with Mr .
