This): 1 Subj: Charter Commission Message: As a result of our meeting Nov. 12, there are several questions I need to refer to you. �� t 1) Did you ever find a copy of the Charter Cem-nission's By-Laws? Bob Toberg thinks he may have some; if we can not find any, Dave Kennedy will send a copy of some he has. 2) The letter from the court did not show Joe Witzman's term as expiring this past month; however, my listing from Dec. 1991 shows that it does terminate this year. Can you shed any factual light on this? 3) We show that Sue Hankner has not attended the past 4 meetings. Under normal circumstances it appears that we must dismiss her, via the court. Can you help direct me in this? 4) The commission formed a sub-committee to investigate additional legal resources in lieu of Dave Kennedy's and to provide second and third party inputs. While this is certainly not a vote of "no confidence" in Dave, it does point out the commission's concern for what is viewed (by some) as a potential conflict of interest. Several members felt that because his firm is also retained by the city, the commission's use of Dave's services could make the commission appear to be too "cozy" with the city. I would assume we have the right to retain our own legal council (and it may well be Dave) but I want to confirm that with you. If I am correct, then the sub-committee will move from a fact-finding mission to one of actively seeking input from the League of Cities, or others, in interviewing possible legal representatives, including Dave.
