The chapter 429 procedure is <br /> almost universally used in Minnesota cities, has been <br /> validated by extensive litigation, and is well <br /> understood by the legal and financial communities. On <br /> the other hand, the procedures under Chapter 8 are, in <br /> the judgment of the writer, ambiguous and contradictory <br /> and will, at some time in the future, cause the city <br /> difficulty in (or make impossible) financing of <br /> assessable public improvements. <br /> X. City Newsletter <br /> Section12.13. - _ _ _ = - = _ - - = - • - <br /> The City Council must publish and circulate a newsletter at the <br /> times and oontainin- the information that the council deems necessa to full inform <br /> the residents of the city of significant city activities.a3 <br /> 2=The commission discussed this matter at length at its <br /> September 23 meeting. There seemed to be general <br /> consensus that a newsletter publication should be <br /> required by charter, but no agreement on what it should <br /> contain, how often it should be published, or what form <br /> it should take. This amendment merely requires <br /> publication but leaves the details to the council and <br /> city staff. This, it can be argued, is what a charter <br /> should do, that is, set policy and leave the details to <br /> the elected and appointed officials/ If they don't <br /> carry out the policy, the voters have a clear remedy at <br /> the polls. If this amendment is adopted, all references <br /> to the newsletter elsewhere in the charter would be <br /> deleted. <br /> XI. Initiative. Referendum and Recall, <br /> Section 5.01.
