2 . 05 Sub-part 7 could potentially be <br /> challenged as not being sufficient to <br /> reach a level of malfeasance or <br /> nonfeasance. City should have a <br /> strong argument that failure to <br /> perform duties without a sufficient <br /> reason for a period of three months is <br /> nonfeasance. <br /> 3 . 05 Has city considered allowing <br /> dispensing of two week delay on <br /> passage of ordinance if council votes <br /> to do so even in a non-emergency when <br /> efficiency, etc. might be better <br /> served? <br /> 3 . 07 Requires both full text and a summary <br /> to be published. This could prove <br /> very costly and impractical for <br /> lengthy ordinances such as zoning <br /> issues. City should consider <br /> authorizing summary-only publications <br /> similar to those described in M.S. <br /> 331A. 01. <br /> 4 . 05 Procedure can get very confusing to <br /> follow as subdivisions 4 and 5 are not <br /> totally consistent. If subdivision 5 <br /> is to be followed, subdivision,4 <br /> should specify ". . . except as provided <br /> in subdivision 5. . . . " In addition, <br /> these two provisions could probably be <br /> re-worded and combined into one easier <br /> to follow subdivision. <br /> 5. 03 Would be easier to prove numbers if it <br /> just required a set percentage of the <br /> voters voting_in the last regular city <br /> election as opposed to requiring a <br /> percentage of Presidential votes. <br /> 5 . 08 Should also provide for recall in case <br /> of nonfeasance. <br /> 6. 03-6 . 04 Has city considered granting authority. <br /> to allow counsel to combine the clerk <br /> and treasurer positions by ordinance <br /> should this become desirable? <br /> 7 . 07 Very strict requirements. How about <br /> emergencies, etc. ? <br /> 10. 01 Typo. The first "by" should be "be". <br />
