w <br /> RESOLUTION NO. <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION DIRECTING THE CITY CLERK NOT TO FILE <br /> CHARTER AMENDMENT CONCERNING TERM LIMITS <br /> WHEREAS, at the November 8, 1994 election, a ballot proposition pertaining <br /> to limiting the number of terms that the mayor and city council members may hold was <br /> adopted by the voters; <br /> WHEREAS, the Minnesota Attorney General has concluded that a term limits <br /> provision such as the one adopted at the November 8, 1994 election violates the <br /> Minnesota Constitution; <br /> WHEREAS, a case involving the City of Minneapolis is currently pending <br /> before the Minnesota Supreme Court that will address the constitutionality of term <br /> limits; <br /> WHEREAS, Minnesota Statutes, Section 410.11 requires the city clerk to file <br /> a copy of the charter amendment with the Secretary of State and County Recorder; <br /> WHEREAS, the city council must provide for the orderly administration of <br /> justice and insure that the Mounds View City Charter does not contain any <br /> unconstitutional provisions; <br /> NOW, T-I EREFORE,-BE-I-T_i,ESOL_V_ED B_Y THE MOUNDS VIEW CITY COUNCIL <br /> that the city clerk is directed not to file the charter amendment that was passed on <br /> November 8, 1994 until the Supreme Court has issued a final ruling as to the <br /> constitutionality of term limits in the case that is presently pending before it <br /> involving the City of Minneapolis. <br /> Jerry Linke, Mayor <br /> (ATTEST) <br /> (SEAL) Samantha Orduno, City Administrator <br /> JJT79264 <br /> MU125-11 <br />
