Constitutional authority for charter government Article 12 Sec. 5. <br /> ARTICLE XII <br /> SPECIAL LEGISLATION;LOCAL GOVERNMENT <br /> Sec. 5. Charter commissions. The legislature shall provide by law for charter commissions. <br /> Notwithstanding any other constitutional limitations the legislature may require that commission members be <br /> freeholders, provide for their appointment by judges of the district court, and permit any member to hold any <br /> other elective or appointive office other than judicial. Home rule charter amendments may be proposed by a <br /> charter commission or by a petition of five percent of the voters of the local government unit as determined by <br /> law and shall not become effective until approved by the voters by the majority required by law. Amendments <br /> may be proposed and adopted in any other manner provided by law. A local government unit may repeal its <br /> home rule charter and adopt a statutory form of government or a new charter upon the same majority vote as <br /> is required by law for the adoption of a charter in the first instance. <br /> 2. Constitutional eligibility to hold office Article 7 Sec. 6. <br /> ARTICLE VII <br /> Sec. 6. Eligibility to hold office. Every person who by the provisions of this article is entitled to vote at any <br /> election and is 21 years of age is eligible for any office elective by the people in the district wherein he has <br /> resided 30 days previous to the election except as otherwise provided in this constitution, or the constitution <br /> and law of the united states. <br /> 3. Charter Law. <br /> MSA 410.21 APPLICATION OF GENERAL ELECTION LAWS. <br /> The provisions of any charter of any such city adopted pursuant to this chapter shall be valid and shall <br /> control as to nominations, primary elections, and elections for municipal offices, notwithstanding that such <br /> charter provisions may be inconsistent with any general law relating thereto, and such general laws shall <br /> apply only in so far as consistent with such charter. <br /> 4. Pursuant to the above constitutional rights and laws, the voters of Mounds View <br /> have adopted a charter amendment imposing term limits on elected councilmembers. <br />
