Section 4. 04 Special and Advisory Elections . The Council <br /> may by resolution order a special or advisory election and provide <br /> the means for holding the election. Notice must be given by the <br /> Clerk-Administrator at least thirty days prior to the election by <br /> posting a notice in at least one public place in each election <br /> precinct, and by publishing a notice at least once in the official <br /> newspaper stating the time and places of holding the election. <br /> Failure to give the notice does not invalidate the election. <br /> Section 4. 05 Vacancy of Municipal Elected Office. <br /> Subdivision 1. When a vacancy in an elected office of the <br /> City. occurs with 365 days orr more remaining in the term of the <br /> vacated office, there must be a special election held within ninety <br /> days after the vacancy occurs to elect a successor to serve for the <br /> remainder of the unexpired term of the office vacated. <br /> Subdivision 2 . The Clerk-Administrator must give at least <br /> sixty days published prior notice of the special election, except <br /> as set forth under subdivision 5 of this section. <br /> Subdivision 3 . The procedure of the election must conform as <br /> nearly as practical to that prescribed for other municipal <br /> elections under this charter. Assumption of duties of elected <br /> officers following the election will occur as soon as practical <br /> after the canvassing board certifies the election. <br /> ( 94-2) 12 <br />
