MOUNDS VIEW CHARTER COMMISSION MINUTES <br /> Regular Meeting - March 20, 1997 <br /> (Please note : due to inadequate posting of the meeting scheduled for <br /> March 6 the meeting was rescheduled for March 20. ) <br /> 1 . Call to Order - by Chair Russ Warren at 7 : 07 p.m. <br /> 2 . Roll Call - Present: Russ Warren, Leon Burton, Diane Wuori , Duane <br /> McCarty, Jean Miller, Roger Stigney, Julie Trude,$ill Warmer <br /> Absent: Laurie Schley, Richard Oman, Michael McGlone, Dave <br /> Long, Rhonda Smieja , Ruth White, Bill Wilson <br /> Motion by Julie Trude, second by Leon Burton to excuse absent members . <br /> MOTION APPROVED 7 ayes 1 nay <br /> 3 . Approval of Minutes - Motion by Julie Trude, second by Diane Wuori to <br /> approve the minutes of the Jan. 30, 1997 meeting. <br /> MOTION APPROVED 8 ayes <br /> 4. The attorney was not available for this evening as per the agenda . <br /> 5 . Discussion of the Charter <br /> Motion by Duane McCarty, second by Leon Burton to recommend Chapter 1 <br /> as written in 95-1 to be included in the Charter. <br /> MOTION APPROVED 8 ayes <br /> Motion by Duane McCarty, second by Diane Wuori to recommend Chapter 2 <br /> as written in 95-1 except for <br /> 2 . 05 Vacancies (Council ) - Roger Stigney asked for future <br /> discussion. Ask attorney about extended illness . <br /> 2 . 07 Salaries - Roger Stigney asked if Council member would be <br /> paid in case of extended absence . <br /> MOTION APPROVED 8 ayes <br /> Motion by Duane McCarty, second by Leon Burton to recommend Chapter 3 <br /> as written in 95-1 with the following changes : <br /> 3 . 01 Motion by Duane McCarty, second Roger Stigney to change <br /> "ordinance" to "resolution" Motion approved 8 ayes <br /> Motion by Duane McCarty, second Julie Trueto change <br /> "twenty-four" to "seventy-two" in two places . <br /> Motionapproved- 8 ayes— <br /> 3 . 06 Motion by Roger Stigney, second Bill Warner to strike the <br /> sentence "An emergency ordinance remains in effect for the <br /> duration of the emergency. " Motion failed 1 aye 7 nays <br /> 3 . 10 Sub. 1 Motion by Leon Burton, second Jean Miller to add <br /> the words "in whole or in part" at the end of the first <br /> sentence . Motion approved 8 ayes <br /> ORIGINAL MOTION APPROVED 8 ayes <br /> 6. Questions to be submitted to the attorney <br /> 1 . Section 2 . 05 Vacancies - How is the extended illness and sbsence of <br /> of a Council member handled? <br /> 2 . Section 4. 02 Term Limits - Does the Minnesota Supreme Court decision <br /> regarding term limits in Minneapolis apply here? <br /> 3 . Clarification of attorney ' s opinion of last year concluding that a <br /> simple majority requirement in the Charter for the adoption of <br /> ordinances holds 4/5 requirements in codes to be null and void . <br /> 4. What determines if a charter is amended or revised? How is a Charter <br /> amended? Can the Charter Commission send a Charter directly to the <br /> voters? <br />
