Item No: 9A <br /> Meeting Date: 11/24/03 <br /> Type of Business: CB <br /> • City of Mounds View Staff Report <br /> To: Honorable Mayor and City Council <br /> From: Kurt Ulrich, City Administrator <br /> Item Title/Subject: Charter Commission Amendments <br /> The City recently received two Charter Commission resolutions (attached). The City <br /> Attorney has advised that these revisions be brought before the city council on <br /> Nov. 24th for direction as to whether the council wants to move forward with the <br /> proposed revisions. <br /> If the Council is in concurrence with the proposed amendments, it is recommended that <br /> staff be directed to put the language in ordinance form for future adoption by the <br /> council. The Attorney also advises that the Resolution concerning Chapter 5 of the <br /> Charter would need to be carefully reviewed, as the present Charter language in <br /> reference to "recall" is not valid. The City Attorney's concern is that, pursuant to the <br /> Minnesota Supreme Court case law, no "recall" language is valid. <br /> Please let me know how you would like to handle this matter.
