Item No: 1OF <br /> III Meeting Date: October 25, 2004 <br /> Type of Business: CB <br /> City of Mounds View Staff Report <br /> To: Honorable Mayor and City Council <br /> From: Kurt Ulrich, City Administrator <br /> Item Title/Subject: Review Recommendations to Charter Commission <br /> Regarding Chapter 5 <br /> On August 23, 2004, the City Council approved the first reading and introduction of <br /> Ordinance 743, an Ordinance amending Chapter 5 of the Mounds View City Charter <br /> relating to "Initiative, Referendum, and Recall." On September 13, 2004, a Public Hearing <br /> was held but the vote was postponed because not all members of the Council were <br /> present. On September 27, 2004, this item was referred back to the Charter Commission <br /> after a lengthy discussion and consideration of comments made by Mr. Duane McCarty. <br /> Discussion: <br /> The intent of the Charter Commission with this change is to clarify language in the charter <br /> relating to the Initiative, Referendum, and Recall. <br /> The Charter Commission Chair has requested that the Council consider specific <br /> recommendations to be considered by the Charter Commission in regard to changes the <br /> Council would like to see to chapter 5. <br /> Based upon discussion at the September 27th meeting, Sections 5.03 and 5.04 of the <br /> proposed charter amendment are suggested to be revised as follows (additions are <br /> double underlined): <br /> Section 5.03. Determination of Petition Sufficiency. The committee must file the <br /> completed petition in the office of the Clerk-Administrator. The Clerk-Administrator shall <br /> provide the number of total ballots cast for President in the most recent Presidential <br /> election. For a petition to be sufficient, the required number of signatures shall be a <br /> percentage of that number. <br /> • Petitions for Initiative and Referendum require at least 15 percent. <br /> • Petitions for Recall, at least 25 percent. <br /> Within 5 workin• da s of recei.t of the •etition the Clerk-Administrator shall notif the <br /> 0 Cit Council that a •etition has been received and is being reviewed in regard to its <br /> sufficiency. Within 10 working days of receipt of the petition, the Clerk Administrator <br /> shall determine its sufficiency. Upon final determination of sufficiency, the Clerk- <br /> Page 1 of 5 <br />
