The specific question raised was whether the reduction <br /> in size of the Charter Commission from fifteen members to eleven members was properly <br /> accomplished pursuant to Minnesota Statutes Chapter 410.05. Based upon the information <br /> available including information provided by the court administrator's office of the Ramsey County <br /> District Court, discussions with current and former Charter Commission members, and review of <br /> recent resolutions adopted by the Mounds View Charter Commission, it appears that the reduction <br /> in size of the Charter Commission from fifteen members to eleven members is generally <br /> appropriate. <br /> Minnesota Statutes Chapter 410.05 sets forth the requirements for the size of a charter commission <br /> as well as for membership in the commission. Minnesota Statutes Chapter 410.05, subd. 1 provides <br /> in part as follows: <br /> The commission shall be composed of not less than seven nor more than 15 <br /> members, each of whom shall be a qualified voter of the City. The size of the <br /> commission shall be determined within the above limits by the court, except that <br /> where the commission is appointed pursuant to a petition of the voters or resolution <br /> • of the governing body of the city, the size of the commission shall be as specified in <br /> such petition or resolution.
