<br />WHEREAS, the applicant has obtained approval of a Preliminary Plat for "Boulevard"
<br />(Resolution 8777); and,
<br />WHEREAS, the City of Mounds City Code, Section 1204.02, Subd 4 (Dedication
<br />Amount), allows for the dedication by the subdivider to the City, up to ten percent (10%) of the
<br />buildable land (land area minus right-of-way dedication), or cash equivalent. The City is
<br />requiring a Park Dedication Fee of $38,576; and,
<br />WHEREAS, the Developer agrees to construct a trail and lighting along Mounds View
<br />Blvd, from Groveland Rd to the western property line, as shown on the Site Plan dated July 6,
<br />2018. Improvements will be constructed to city standards, and installed at the Developer's
<br />expense.
<br />NOW, THEREFORE, BE IT RESOLVED, the City Council finds that the request is
<br />consistent with the City of Mounds View City Code, Title 1000 (Building and Development
<br />Regulations), Title 1100 (Zoning Code), and Title 1200 (Land Subdivision), and the
<br />Comprehensive Plan; and,
<br />NOW, THEREFORE, BE IT FINALLY RESOLVED, based upon the above findings,
<br />the information and documents regarding the proposed Final Plat, the Staff Report, the Plat
<br />Opinion, testimony of the applicant, and in consideration of public testimony, the City Council
<br />does hereby approve the Final Plat of `Boulevard", with the following conditions:
<br />1. All utilities within the development shall be located underground.
<br />2. The Developer shall satisfy all requirements of the City Engineer (Stantec), as stated in its
<br />review comments, dated July 31, 2018; and,
<br />The Developer shall obtain applicable permits from the Rice Creek Watershed District
<br />(RCWD), and submit a signed/recorded copy of the Maintenance Agreement for storm
<br />water management facilities to RCWD; and,
<br />4. The Developer agrees to construct at the Developer's expense, a public trail and trail
<br />lighting to city standards as shown on the plan set, dated July 8, 2018, or as amended and
<br />approved by City Staff and Ramsey County. These improvements shall be constructed at
<br />the time the building is constructed; and,
<br />S. The Developer shall submit a Landscape Escrow to the City in the amount of $33,000
<br />(150% of estimated cost of materials and labor). The City shall hold this escrow in a non-
<br />interest bearing account. On or about one-year after landscaping is installed, the City will
<br />inspect the property. If all landscaping has survived, the escrow will be returned to the
<br />Developer. If all, or a portion of landscaping has not survived, the City will notify the
<br />Developer, and the Developer shall replace the landscaping. The City may retain a
<br />proportionate amount of this escrow until one-year after the replacement landscaping is
<br />installed and inspected for survivability; and,
