such hearing be held at such time and upon such notice as the Council may determine. After such <br />a hearing, the Council may grant or refuse to grant the license. <br />SECTION 18. The City Council of the City of Mounds View hereby amends Title 500, Chapter <br />511 of the Mounds View Municipal Code by deleting Chapter 511 in its entirety. <br />SECTION 19. The City Council of the City of Mounds View hereby amends Title 500, Chapter <br />513, Section 513.06, Subdivision 3 of the Mounds View Municipal Code by adding the double - <br />underlined material and deleting the stricken material as follows: <br />Subd. 3. License Fee: <br />a. The annual license fee is two thousand five hundred dollars ($2,500.00). <br />b. Each application for a license shall be submitted to the City Administrator and <br />payment made to the City. Each application for a license shall be accompanied by payment <br />in full of the required license fee. Upon rejection of any application for a license, the City <br />shall refund the license fee. <br />C. All licenses shall expire on the last day of June in each year. Each license shall be <br />issued for a period of one (1) year, except that if a portion of the license year has elapsed <br />when the application is made, a license may be issued for the remainder of the year for a <br />pro rated fee. In computing such fee, any unexpired fraction of a month shall be counted <br />as one (1) month. <br />d. No part of the fee paid by any license shall be refunded, except that a pro rata <br />portion of the fee shall be refunded in the following instances upon application to the City <br />Administrator within thirty (30) days from the happening of the event, provided that such <br />event occurs more than thirty (30) days before the expiration of the license and renders the <br />adult establishment inoperable: <br />(1) Destruction or damage of the licensed premises by fire or other <br />catastrophe. <br />(2) The licensee's illness. <br />(3) The licensee's death. <br />(4) A change in the legal status making it unlawful for the licensed business to <br />continue. <br />C. <br />Eaeh application shall eentain a pr-avision an the application in bold print indicating <br />that-anyAnv withholding of information or the providing of false or misleading information <br />will be grounds for denial or revocation of a license. Any changes in the information <br />provided on the application or provided during the investigation shall be brought to the <br />attention of the City Council by the application or licensee. If said changes take place <br />during the investigation, said data shall be provided to the Police Chief in writing and they <br />shall report the changes to the City Council.
