MOUNDIVIEW <br />City of Mounds View Staff Report <br />From: Administrator Zikmund <br />To: Honorable Mayor Mueller and Council <br />Date: July 2, 2018 <br />Re: Rain Gardens <br />Background: <br />On April 30, 2018 resident Dave Farrell came to City Hall to express concerns over the rain <br />garden in his front yard installed during the street reconstruction program. Mr. Farrell had <br />previously contacted public works and Director Peterson is aware of his concerns. <br />This event triggered research efforts to better understand the issue which while ongoing, have <br />culminated to the point of providing information to council and seeking direction. <br />Rice Creek Watershed District (RCWD): <br />See Appendix A for the legislative history of Watersheds (Created in 1972, 46 units, boundaries <br />follow natural drainage, named after distinct water feature in area such as lake or river) and <br />Appendix B for historical information and board composition of the Rice Creek Watershed <br />District. <br />Appendix C is the RCWD rule on Storm Water Management which provides the specific detail <br />for requirements and design of storm water components when any construction occurs. <br />Appendix D is the bylaws of RCWD. <br />Watersheds have broad rule making authority and their enforcement of their rules is detailed in <br />Rule K of their procedure document, violations are a misdemeanor and/or cease and desist <br />orders. <br />Appendix G details their variance process. <br />Policy Issues: <br />There are four policy issues that bear discussion and resolution. <br />1. We have three open permits from our road improvement program where functionality <br />and assessment of capacity have not been completed. Functionality is directly related <br />to observation by agents of RCWD and Mounds View staff observing diverters and/or <br />obstructions in or near the curb cut/inflow portion of the garden.
