Consider Motion Retaining the Monetary Limits on Statutory Tort Limits <br />Established by Minnesota Statutes 466.04 as Recommended by City Attorney Long <br />(Presenter Bruce Kessel, Finance Director). <br />Finance Director Kessel told the Council that the League of Minnesota State Insurance Trust <br />came up with an option for cities so they could waive their statutory limit. Approximately 90-95 <br />percent of all cities have not opted for the waiver. It would cost the City for additional premiums. <br />Attorney Long stated his main concern is that if a great number of cities did start waiving their <br />statutory limit it would set a precedent with the Legislature to raise the cap. <br />MOTION/SECOND: Gunn/Stigney to retain the Monetary Limits on Statutory Tort Limits <br />Established by Minnesota Statutes 466.04 as recommended by the City Attorney. <br />VOTE: Ayes - 4 Nays - 0 Motion carried. <br />G. Authorization to Enter Into an Option to Purchase the Midland Videen Property ad <br />• To Send Out a Request for Proposals. <br />Director Jopke gave his presentation as follows: <br />The Midland Videen property is located south of the Community Center property and east of <br />Edgewood Drive. The property is approximately 9.4 acres in size. Of that 9.4 acres 1.5 acres is <br />developable with the remainder being wetland. When Edgewood Drive is realigned, the City will <br />have an additional 1.5 acre site which could be developed. Because the two sites would be <br />contiguous, it would make sense to market them together to get the best development. Staff is <br />recommending that the City maintain what gets developed on the site so that it is compatible with <br />the City Center, City Hall, and the wetland. Staff is recommending that the City either acquire the <br />Midland Videen property outright or acquire an option to purchase the site. <br />The Community Center project is experiencing a problem in that it does not have enough area, <br />because of an existing wetland, to build a parking lot. By purchasing the Midland Videen <br />property and mitigating the Community Center parking lot wetland to that site the problem would <br />be solved. <br />The current asking price for the Midland Videen property is $250,000. A six-month option could <br />be purchased for $20,000. <br />An alternate course of action would be to not purchase or option the Midland Videen Property at <br />this time. The City could ask for proposals which include both properties. The RFP could <br />
