He stated these issues represent the views of <br />each Council Member, and he would like to see them taken as such. <br />Mr. Jahnke stated he had read the Mayor's Message in the Mounds View Matter, and this was <br />good. He stated City Administrator Whiting had indicated that some of the employee turnover in <br />the City is a based upon this, however, he was not certain he agreed, as there has been much <br />turnover for many companies lately. He reiterated that these are simply views. <br />There were no further requests or comments from the floor. <br />10. COUNCIL BUSINESS <br />A. A Public Hearing to Consider a New Tobacco License for Tobacco Empire at <br />2563 %2 Highway 10. <br />Mayor Coughlin opened the Public Hearing at 7:21 p.m. <br />Assistant to the City Administrator Reed stated approximately one month prior, she received an <br />application for a new tobacco license at 2563 %2 Highway 10, which is located in Mounds View <br />Square. She indicated that two different individuals had contacted her regarding the application <br />• for this address, and the application was submitted by an individual named "John," who provided <br />no last name, on behalf of Nayfha Wraidt. <br />Assistant to the City Administrator Reed stated she sent a letter to Ms. Wraidt indicating that this <br />item would be listed on the current City Council agenda for consideration, however, she has not <br />received a response. She advised that some of the information contained in the application was <br />not verifiable, including the insurance policy numbers. She indicated that the Police Department <br />was unable to confirm the existence of the applicant, and although this does not mean the <br />individual does not exist, there is no record of this person in State and Federal records. <br />Assistant to the City Administrator Reed stated she has spoken with City Attorney, Scott Riggs <br />regarding the application, and he has advised that the request be denied, at least until all of the <br />necessary information is provided to complete the application. <br />City Attorney Long stated the City Code is somewhat vague and does not specifically address <br />the situation of acting upon a new license request, and the procedural steps required to deny the <br />request. He explained that the Code only addresses situations of revocation or suspension of the <br />tobacco license, which require 10-day notice of adverse action. <br />City Attorney Long recommended that the Council continue the public hearing, and not grant the <br />tobacco license at this time, as the application is incomplete. He further recommended the <br />Council direct staff to provide the applicant with written notice, 10-days prior to the continuation <br />of the public hearing, and advise that at that point, denial of the license will be recommended, <br />. based upon the factors that have been indicated. He pointed out that this would prevent the <br />procedural issue of whether or not the applicant received proper notice of the City's intent to <br />deny. He suggested it might be appropriate to clarify these situations in the Code, at some point <br />in the future. <br />
