Thomas introduced new language from Scott Riggs!�ityvegal could. which <br /> could be added in Section 5.01 after the MN Statute 410.20 reference. It was suggested <br /> the language be an endnote and be included with an "*"any time we reference 410.20. <br /> Members reviewed the letter from Mr Riggs and agreed to include the following in the <br /> endnote. "Minnesota courts have limited the powers of initiative and referendum to <br /> ordinances which are legislative in character. General legislative acts lay down some <br /> permanent and uniform rule of law, administrative acts relate to daily administration of <br /> municipal affairs, and quasi judicial acts are the product of investigation, consideration <br /> and deliberate human judgment based upon evidentiary facts of some sort." <br /> Discussion then moved to focus on Revision —DRAFT 20060502_2 language and <br /> changes approved by consensus are reported here in line order sequence and not in order <br /> discussed. <br /> 1. Line 78, add previously discussed endnote "*" after"General Voter Authority.". <br /> 2. Line 113, place a colon after"following" and move "required number of signatures"to <br /> each of the bulleted items following. <br /> 3. Line 114 to 117, intent the language for readability. <br /> 4. Line 151, add previously discussed endnote "*" after"Initiative.". <br /> 5. Line 167, add "and 5.04"after"5.03". <br /> 6. Line 168 place a comma after "ordinance"and "charter", add "normal ordinance" <br /> before"adoption process", place comma after"adoption process" and insert "which <br /> does not exclude the referendum process defined in 5.07,". <br /> 7. Line 186. add"normal ordinance" before "adoption process", place comma after <br /> "adoption process" and insert "which does not exclude the referendum process <br /> defined in 5.07.". <br /> Chair J. Thomas requested all members review the suggested language changes and the <br /> flow charts planned to be in the appendix for consistent language and process flow. He <br /> asked members to call him directly with any suggested changes. <br /> c. Review Resolution 2006-04 Practices for Documentation Modifications. <br /> Discussion focused on language changes. <br /> 1. At the top of the resolution, correct the date to June 13, 2006 and drop "DRAFT" <br /> 2. In paragraph 1, sentence 2, add "therefore"before "adopts" and drop second period at <br /> end of sentence. <br /> 3. In item 8, make "deletion"plural and correct spelling of"fist"to "first." <br /> 4. In item 9, add a comma after"complete- and change"striked"to "stricken" <br /> Motion by B. Doty, second by C. Mueller to approve the Resolution 2006-04 on <br /> Commission Documentation Practices. APPROVED <br /> 8. New Business <br /> a. Future Agenda Items <br /> 1. Chapter 5 and new Resolution <br /> 2.
