RESOLUTION NO. 7136 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />A RESOLUTION APPROVING A WETLAND BUFFER PERMIT FOR A BILLBOARD <br />LOCATED ON SYSCO OUTLOT A, REQUESTED BY CLEAR CHANNEL OUTDOOR; <br />PLANNING CASE NO. WB07-001. <br />WHEREAS, Glear Channel Outdoor, the Applicant, has requested a Wetland Buffer <br />Permit to allow for the construction of a billboard on SYSCO Outlot A, , as shown on the <br />attached survey labeled Exhibit A; and, <br />WHEREAS, the proposed billboard location is consistent with the amended and <br />restated acquisition and relocation agreement between the City of Mounds View and the <br />Applicant; and, <br />WHEREAS, Section 1010.08 of the Municipal Code states that a Wetland Buffer <br />Permit is required when any development activity occurs within 100 feet of a wetland; and, <br />WHEREAS, the City Council has found that wetlands within the City, as part of the <br />ecosystem, are critics! to the present and future health, safety and general welfare of the <br />land, animals and people within the City, as well as within the Rice Creek Watershed <br />District; and, <br />WHEREAS, the proposed billboard satisfies the requirements of the Zoning Code <br />and Building Code; and, <br />WHEREAS, the proposal satisfies all of the wetland requirements of Chapter 1010; <br />and, <br />WHEREAS, on April 23, 2007, the Mounds View City Council approved Resolution <br />7059, a resolution approving an Interim Use Permit to constructthe proposed billboard, with <br />stipulations. <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council <br />approves the Wetland Buffer Permit requested by Clear Channel Outdoor to construct the <br />proposed billboard to be located on SYSCO Outlot A alongside Trunk Highway 10 in the <br />City of Mounds View, and the pervious access road to service said billboard. <br />a. Only clean fill, if any is needed, shall be brought onto the site. <br />b. No waste, construction or otherwise, shall be allowed to enter into the <br />wetland or any adjoining areas. <br />c. The construction of the billboard shall not impede or otherwise restrict the <br />natural flow of surface water and stormwater runoff. <br />
