RESOLUTION 7071 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION SUSPENDING THE MULTIPLE DWELLING LICENSE AT <br />7750 SILVER LAKE ROAD <br />WHEREAS, Michael J. Fox and Jennifer Fox are the owners of athree leve123-unit multiple <br />dwelling property located at 7750 Silver Lake Rd, Zoned R-4, High Density Residential, legally <br />described as follows: <br />VELMEIR CVS ADDITION THAT PART OF LOT 3 BLK 1 IN T.I. 90 <br />WHEREAS, on March 22, 2007, Staff received a report of water leaking into 3rd floor <br />apartments at the apartment building located at 7750 Silver Lake Road; and <br />WHEREAS, on March 22, 2007, Staff inspected the premises at 7750 Silver Lake Road, <br />issued a correction notice to Michael J. Fox citing violations of the City Housing Maintenance Code, <br />and scheduled a follow up inspection for Apri16, 2007; and <br />WHEREAS, on April 6, 2007, Staff performed a follow up inspection and determined that <br />corrective actions had not been completed as required; and <br />WHEREAS, on April 9, 2007, Staff issued a revised correction notice to Michael J. Fox <br />requiring completion of corrective actions no later than April 19, 2007 or the matter would be <br />referred to the City Council consistent with Chapter 1012 of the City Code; and <br />WHEREAS, corrective actions had not been completed in a satisfactory manner on Apri119, <br />2007 and Staff had not received a mitigation plan outlining actions planned to remedy the conditions <br />present. <br />NO W THEREFORE, BE IT RESOLVED, that if all relevant corrective actions have not been <br />completed by May 29, 2007, the Multiple Dwelling license for the entire premises at 7750 Silver <br />Lake Road shall be suspended based on the following: <br />1. The City Council finds that the multiple dwelling property at 7750 Silver Lake Road is <br />currently in violation of Chapter 1005 of the City Code (Housing Maintenance) <br />2. In accordance with Section 1012.02 Subdivision 9c of the City Code and effective May 29, <br />2007, the City Council does hereby suspend the Multiple Dwelling license for the entire <br />premises at 7750 Silver Lake Road. <br />3. Rental units that are vacant at the date of this Multiple Dwelling License suspension may not <br />be offered for occupancy. <br />4. No rental units becoming vacant in the facility may be relet or offered for occupancy during <br />the period the Multiple Dwelling License is suspended. <br />
