Resolution 1057-16 <br />October 19, 2016 <br />Page 2 <br />WHEREAS, the Mounds View City Council will hold an advertised Public Hearing on <br />October 24, 2016 for the Conditional Use Permit; and <br />WHEREAS, according to Section 1125.01, Subd 3 of the Mounds View Municipal <br />Code, the City Council is to review a standard set of criteria when considering a Conditional Use <br />Permit, including making Findings; and, <br />NOW THEREFORE, BE IT RESOLVED, that the Mounds View Planning <br />Commission recommends that the criteria as identified in Section 1125.01, Subd 3(b) are <br />satisfied and makes the following findings of fact related to its decision: <br />1. The oversized attached garage will not create an excessive burden on existing <br />parks, schools, streets and other public facilities and utilities which serve or are <br />proposed to serve the area. <br />2. The oversized attached garage will be sufficiently compatible or separated by <br />distance or screening from adjacent residentially zoned or used land so that <br />existing homes will not be depreciated in value and there will be no deterrence to <br />development of vacant land. <br />3. The oversized garage and site shall have an appearance that will not have an <br />adverse effect upon adjacent residential properties. <br />4. The oversized garage, in the opinion of the Planning Commission, is reasonably <br />related to the overall needs of the City and to the existing land use. <br />5. The oversized garage is consistent with the purposes of the Zoning Code and the <br />purposes of the zoning district in which the applicant intends to locate the <br />proposed use. <br />6. The oversized garage is not in conflict with the Comprehensive Plan of the City. <br />7. The oversized garage will not cause traffic hazards or congestion. <br />8. Adequate utilities, access roads, drainage and necessary facilities have been or <br />will be provided. <br />NOW THEREFORE, BE IT FURTHER RESOLVED that the Mounds View <br />Planning Commission does herby recommend approval of a Conditional Use Permit for an <br />Accessory Building in excess of 952 sq ft in area, submitted by property owners Cynthia Brown <br />and Terry Brown, subject to the following conditions: <br />1. The applicant shall obtain a building permit for the garage addition, and shall <br />construct the garage according to Building Code, and consistent with plans dated <br />Sept 20, 2016. <br />2. The garage shall not be used for commercial purposes, living space or other uses <br />not allowed within the R-1 Single -Family Residential district or by the Zoning <br />Code. Should the use change for which the permit was granted; the Conditional <br />Use Permit shall be considered null and void. <br />
