Promptly upon its receipt of such recommendations, <br />the Council shall give due consideration to the <br />recommendations and shall revise the rates, fees and <br />charges respecting the Golf Course and shall alter the <br />City's methods of Golf Course operation; said revisions <br />or alterations need not comply exactly with the <br />independent golf course consultant's recommendations <br />but they shall be reasonably projected by the Council <br />to bring the City into compliance with the Rate <br />Covenant. <br />(b) Comtaletion of Facilities. The City shall <br />cause all Golf Course facilities financed in whole or <br />in part from the proceeds of the bonds payable from the <br />Debt Service Account to be fully acquired, erected, <br />furnished, equipped and paid for with the proceeds of <br />the bonds and other moneys appropriated and legally <br />available for that purpose; shall cause all such <br />construction to be done under contracts awarded in <br />accordance with applicable law and accompanied by <br />completion bonds in sums equal to the full amounts of <br />the respective contracts; and shall cause each contract <br />to be performed under the direction of an architect or <br />engineer designated by the City, who shall give <br />continual supervision while the contract is being <br />performed. <br />• (c) Ownership and Operation. The City shall <br />continue to own and operate the Golf Course, shall <br />cause the Golf Course to be maintained in good and <br />efficient operating condition, free from all liens on <br />the revenues or the physical properties thereof, and <br />will not sell or otherwise dispose of any capital <br />assets of the Golf Course except at their fair market <br />value and shall use the proceeds of any such sale or <br />disposition to procure other capital assets of equal <br />usefulness for the purposes of the Golf Course, or to <br />pay and redeem or defease bonds payable from the Debt <br />Service Account. The City shall at all times after <br />commencement of operation of the Golf Course employ a <br />general manager for the operation of the Golf Course <br />who has experience in operating golf facilities and who <br />may, but need not be, a golf professional. <br />(d) Books and Records. The City shall cause <br />proper and adequate books of record and account to be <br />maintained, reflecting all receipts and disbursements <br />and all accrued claims and expenses in connection with <br />the operation and maintenance of the Golf Course, and <br />z~8a2 <br />23 <br />
