Resolution 9080 <br />Page 2 <br />WHEREAS, the Planning and Zoning Commission reviewed the application on <br />February 6, 2019, approving Resolution 1093-19, recommending approval of the Minor <br />Subdivision; and, <br />WHEREAS, the City Council has reviewed the Staff Report, determining that the <br />proposed Minor Subdivision is in conformance with the City Code, and Comprehensive <br />Plan; and, <br />WHEREAS, in accordance with City Code, Section 1204.02 (Dedication of <br />Lands), a park dedication fee will be required in the amount of $4,972 (10% of <br />Estimated Market Value of Parcel B), to be paid to the City prior to recording of the <br />Resolution; and, <br />NOW, THEREFORE, BE IT RESOLVED, that the applicant shall have six <br />months from final approval to file proper documentation with Ramsey County, including <br />new deeds and easement documents, and furnish proof of such recording to the City. If <br />such action is not accomplished by the date so indicated, this Minor Subdivision <br />approval shall be considered null and void; and, <br />NOW, THEREFORE, BE IT FINALLY RESOLVED that the Mounds View City <br />Council approves a Minor Subdivision of 8456 Red Oak Drive subject to the following <br />stipulations: <br />1. The Applicant shall grant the following easements to the City: <br />A. An easement for drainage and utility purposes around the perimeter of the <br />new lots, measuring 5 feet in width along rear and side lot lines, and 10 <br />feet in width along frontage lot lines; and, <br />B. An easement for right-of-way purposes over the eastern 33.00 feet of both <br />parcels, all as depicted in the Property Split Exhibit. <br />2. The Applicant shall amend the Certificate of Survey if any changes are <br />required by Ramsey County. <br />3. The Applicant shall pay to the City, a Park Dedication Fee of $4,972, and all <br />costs associated with the City's review of the application, including City <br />Engineer, and City Attorney fees. Fees shall be paid within six months of <br />approval of this Minor Subdivision and concurrent with the recording of deeds, <br />and prior to issuing a building permit for more than one house. <br />
